Terms of Service

1. The agreement

These terms are between you and Swishful Athletics LLC (State of Georgia, United States), which operates FastBreak Powered by Swishful Athletics. By creating an account you agree to these terms, the Privacy Policy, and the waiver in section 7.

2. Who may use FastBreak

You must be at least 13 years old. If you are 13–17, a parent or legal guardian must sign the consent and waiver before you can generate or log training; the guardian agrees to these terms on your behalf and with you. We do not knowingly allow accounts for children under 13, and we close any we find. One account per person, and you are responsible for keeping your login secure.

3. What we provide

FastBreak generates basketball and strength training programs from the information you give us, lets you log work, and awards points, ranks and badges. Programs, scouting reports, Swishful Prehab suggestions and coaching notes are general training guidance and recommendations only. They are not medical advice, physical therapy, diagnosis or treatment, and they do not replace a physician, physical therapist or athletic trainer. We do not guarantee any particular athletic result, scholarship, roster spot or outcome.

4. Subscriptions, billing and international payments

• Rookie is free. Starter, Baller and Pro Access are paid monthly subscriptions, and Swishful Prehab is a paid add-on.
• Payments are processed by our payment provider, which acts as merchant of record and can accept cards and local payment methods in most countries and currencies.
• Prices are shown before checkout. Where required, applicable sales tax, VAT or GST is calculated and added at checkout and shown on your invoice.
• Subscriptions renew automatically each month until cancelled. You can cancel any time and keep access until the end of the paid period.
• If you are a consumer in the UK or EU you have a statutory 14-day right to cancel; by starting to use a paid feature immediately you ask us to begin supply, and you may be charged for what you used.
• Outside that right, payments are non-refundable except where required by law or where we cannot deliver a paid feature.
• We may change prices with at least 30 days' notice before your next renewal.
• Failed or reversed payments may pause paid features until resolved.

5. Your content

You keep ownership of the videos, messages and logs you upload. You grant us a limited licence to store and display them so we can operate the service and so your coach can review them. Do not upload anything you do not have the right to share, anything showing other people without their permission, or anything unlawful, abusive or sexual. We may remove content and suspend accounts that break these rules.

6. Fair play

Points, ranks, badges, court reigns and the leaderboard exist to reward real work. Falsifying logged numbers, automating logging, sharing accounts or manipulating the leaderboard may result in reset points, removal from the leaderboard or account termination. Points and ranks have no monetary value.

7. Assumption of risk, waiver and release

Basketball, sprinting, jumping, plyometrics and resistance training carry an inherent risk of injury, including serious injury. By training with FastBreak you confirm that:

• You are voluntarily choosing to train and are medically cleared, or you have consulted a physician if you have any condition, injury, pregnancy or symptom that training could affect.
• You will stop immediately and seek medical attention if you feel pain, dizziness, chest discomfort or anything unusual.
• You will train in a safe space with equipment in good condition and will scale, substitute or skip any movement that is not right for you that day.
• You assume all risk of injury, and to the fullest extent permitted by law you release Swishful Athletics LLC and its coaches from claims arising from your participation, other than for gross negligence, wilful misconduct, death or personal injury caused by our negligence where that liability cannot be excluded by law.

If the athlete is under 18, the parent or legal guardian accepts this section on the athlete's behalf when signing the consent link, and confirms the athlete is fit to participate.

8. Limitation of liability

The service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, our total liability to you for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars. We are not liable for indirect or consequential loss. Nothing in these terms limits rights that cannot be limited under the law that applies to you as a consumer.

9. Ending your account

You can stop using FastBreak and request deletion at any time from your account and privacy page. We may suspend or close an account that breaks these terms, and will tell you why unless we are legally prevented from doing so.

10. Governing law

These terms are governed by the laws of the State of Georgia, United States, and the courts of Georgia have jurisdiction, except that consumers in the UK and EU keep the protection of their local law and may bring claims in their local courts.
